An occupier of a unit must not:-
fail to observe the Body Corporate Rules or fail to procure observance by guests and invitees;
smoke or permit invitees to smoke in any unit, unit balcony or common area;
keep any animal or bird in any unit, on any unit balcony or common property; except that a cat may be kept inside a unit provided the occupier has written permission from the Body Corporate committee and complies with any conditions laid down by the Building Manager for the care and welfare of the animal. e.g. fully enclosed litter box, kitty litter to be cleaned daily, etc. If the occupier fails to comply with the conditions the Building Manager may revoke the Body Corporate Committee permission after discussion with the Body Corporate Chairperson
use a principal unit for anything other than private residential accommodation unless a variation is approved in writing by the Body Corporate.
that Units B, C, F, & G; may accommodate no more than 4 persons and Units A, D & E may accommodate no more than 2 persons except that Units lA, 2A, 3A and l0A may accommodate no more than 3 persons;
move possessions into, or out of, the building without permission from the Building Manager 24 hours in advance;
park on the area designated as a loading bay without the Body Corporate consent;
use the lift in any unsafe manner by loading it with items that are too heavy, by jumping in the lift car or by holding the lift doors open;
damage or deface the common property;
leave the unit or common entrance ways inadequately secured at any time or give any access key, card, or gate remote transmitter, to another person without the permission of the landlord;
fail to immediately notify the Building Manager in writing of the name and contact details of any person who has a unit key, access tag and/or gate remote transmitter;
create noise likely to interfere with the use or enjoyment of the unit title development by other owners or occupiers at any time of the day or night;
in any way infringe upon the right of every resident to the quiet enjoyment of their unit;
allow any rubbish to accumulate in any unit and must dispose of rubbish hygienically and tidily in properly sealed bags in the rubbish receptacles provided by the Body Corporate;
interfere with any means of escape from fire which includes all active and passive protection features required to warn people of fire and to assist in protecting people from the effects of fire in the course of their escape from the fire;
[N.B. Smoke detectors are continuously monitored and the occupier will pay the cost incurred to reinstate detectors that have been removed, interfered with or covered over. (This cou1d be up to $500 per device) Further, a fine of $3000 may apply for interfering with any fire warning/protection device.]
waste water, or use the common area power without permission from the Body Corporate;
interfere with the reasonable use or enjoyment of the common property by other owners or occupiers;
throw, or allow to fall, any object including, but not limited to, rubbish, refuse, cigarette litter, dust from the beating of any mat or carpet, liquid or other substances in the lifts, out of the windows or doors, down any staircase, from balconies or from the roof of the building;
bring any illegal or dangerous substance to the building, create a fire hazard or do anything which may prejudice the terms of any policy of insurance held by the Body Corporate;
fail to notify the Building Manager when a person no longer has authorized access and whether that person has an access tag, key and/or gate remote or not;
park, or permit others to park, motor vehicles in any place other than the car parking space(s) designated for the unit;
allow the balcony to be used for storage of any items other than plants;
feed any animal or bird in any unit, on any unit balcony, or common property;
allow any form of clothing, bedding or other articles to be hung from windows, balconies or on the outside of the unit in any manner that is visible from the exterior of the building.
fail to advise the landlord or Building Manager of any broken glazing; any blockage of pipes and/or inappropriately deposit any matter in any pipe or misuse the building plumbing in anyway;
use any chemicals, burning fluids, including, but not limited to, butane or propane (LPG) gas in containers exceeding 350grams for cooking, heating or lighting in the premises nor in any way increase a risk of fire or explosion in their unit or on the common property;
fail to observe all necessary and proper emergency evacuation procedures and generally co-operate with the Body Corporate in performing fire drills and any other such procedures;
prevent the Body Corporate from entering the unit to repair, test or examine any services in or passing through the unit and to ensure that there is compliance with the Body Corporate rules at any time it deems necessary;
allow any person to service or repair or otherwise interfere with any electrical wiring, fittings or appliances nor repair or otherwise interfere with any plumbing or associated fittings without the person doing the service or repair being approved by the Building Manager (this does not apply to the replacement of light bulbs);
leave rubbish, recycling material or surplus possessions on the common property;
hang any window tinting or treatment other than curtains or blinds that present a neutral or colourless appearance when viewed from the exterior of the building;
affix or display on any part of the outside of any unit any TV aerial, antenna, sign, notice or other object without the prior consent of the Body Corporate;
allow any unit to fall into a state of disrepair, neglect, become unsanitary or infested by vermin or insects;
use the unit or permit the unit to be used for any purpose that may be illegal, injurious or degrading to the reputation of the building;
use the unit or permit the unit to be used for any sex industry business;
access the roof ladder and roof without the written consent of the Body Corporate.
A) The Body Corporate may apply to the Tenancy Tribunal to terminate the tenancy of any tenant who does not comply with these rules after one verbal and two written requests to comply and the Body Corporate, tenant, owner(s) and owner's agent will abide by the Tenancy Tribunal's decision.
B) An occupier shall pay the Building Manager the fee posted on the office door to unlock the unit door, outside of office hours.
C) Each occupier over the age of 12 years must have their own unit key and access tag; keys and access tags are the property of the unit owner.
D) An occupier shall immediately notify the landlord and Building Manager of any leaking or dripping plumbing; any defect in any part of the property that comes to the occupiers attention.
E) The Body Corporate has the right to recover all costs associated with any repairs or cleaning resulting from negligence or willful damage.
F) An owner or occupier may not allow Accessory Units(AU), designated as carparks, to be used for anything other than parking cars, motorbikes, bicycles and mobility scooters.
G) Vehicles parked in designated carparks are to be in a road legal condition.
